In plain English
These are the rules for the freight we carry. In short: a quote becomes a contract when we accept your booking; you're responsible for accurate descriptions, proper packaging and declaring dangerous goods; transit times are estimates unless guaranteed in writing; freight travels at owner’s risk unless you arrange transit cover with us in writing first. Summary only. The clauses below govern.
These Service Conditions set out the terms on which Frostac Pty Ltd (ABN 44 687 896 206), trading as Quick Freight Line, accepts and carries freight. They apply to every consignment we carry unless we have agreed different terms with you in writing.
1. Application
By asking us to collect, carry or deliver freight, you agree these conditions apply to that consignment and to our relationship with you. Where you engage us on behalf of another party (for example as their agent), you confirm you are authorised to bind them to these conditions.
2. Quotes and Acceptance
A quote is an estimate based on the information you give us and is valid for the period stated. A binding contract of carriage is formed only when we accept your booking. Charges may be adjusted if the actual freight differs from what was quoted, for example in weight, dimensions, quantity or handling requirements.
3. Your Responsibilities
In plain English
Describe the freight accurately, pack it properly, declare any dangerous goods, and make sure sites are accessible. Getting these wrong can add cost or make you liable.
You are responsible for ensuring that:
- the freight is accurately described, including its weight and dimensions;
- the freight is properly and securely packaged to withstand normal handling and transport;
- any dangerous goods are correctly classified, packaged, labelled and declared to us before carriage (see clause 4);
- collection and delivery points are accessible and someone is available to load or receive the freight; and
- you hold the necessary rights to consign the goods.
4. Dangerous Goods
You must not consign dangerous or hazardous goods without declaring them to us in advance and providing the required information (including UN number, class, packing group and Safety Data Sheet). We carry dangerous goods only where we have agreed to do so and in accordance with the Australian Dangerous Goods (ADG) Code. Undeclared dangerous goods put people at risk and may make you liable for any resulting loss or damage.
5. Delivery and Risk
We will use reasonable efforts to collect and deliver within the estimated transit time, but transit times are estimates and not guaranteed unless we have agreed a guaranteed service in writing. Where a delivery point is unattended or a required unloading method (such as a tail-lift) was not advised, additional charges or re-delivery may apply.
6. Liability
In plain English
Freight travels at owner’s risk. Unless you arrange transit cover with us in writing before collection, a loss sits with you, so tell us if a consignment needs covering. Claims must reach us within 7 days of delivery. Your rights under the Australian Consumer Law that can’t be excluded still apply.
Freight is carried at the owner’s risk. To the extent permitted by law, and unless you have arranged transit cover with us in writing before collection, we are not liable for loss of, damage to, deterioration of, or delay in delivering freight, however that loss or damage is caused.
Where liability cannot lawfully be excluded, our liability is limited, at our option, to re-supplying the carriage service or paying the cost of having it re-supplied.
We are not liable in any circumstances for indirect or consequential loss, including loss of profit, loss of contract, loss of market, or production downtime.
Any claim must be notified to us in writing within 7 days of delivery, or within 14 days of the expected delivery date where freight has not arrived, so that we can investigate while the evidence is still available.
Nothing in these conditions excludes, restricts or modifies any consumer guarantee or other right under the Australian Consumer Law that cannot lawfully be excluded.
7. Insurance / Transit Cover
We do not insure your freight. Our own insurance covers our legal liability as a carrier. It is not goods-in-transit cover for you, and it does not make good a loss that sits with the owner under clause 6.
If you want a consignment covered, ask us in writing before collection and tell us its declared value. We will come back to you with a price for transit cover. Cover applies only once we have confirmed it in writing and it is charged separately to the freight.
For high-value, fragile or hard-to-replace freight we strongly recommend arranging cover, either through us or through your own insurer.
8. Charges and Payment
Charges are as quoted or as set out in your account terms, plus any applicable surcharges (for example fuel, tail-lift, futile pick-up, or dangerous goods handling), which we will identify. For approved account customers, payment is due within 14 days of the date of invoice. If you do not hold an approved account, payment is required before collection or on delivery. We may charge interest on overdue amounts at 2% above the Reserve Bank of Australia cash rate, recover reasonable costs of collection, and hold further consignments while an account is overdue. GST applies where relevant.
9. Chain of Responsibility
We operate under the Heavy Vehicle National Law and expect all parties in the supply chain to meet their Chain of Responsibility obligations. See our Chain of Responsibility policy for how this affects both of us.
10. Governing Law
These conditions are governed by the laws of New South Wales, Australia. Last updated: .
